The Fight Continues for Association Health Plans

Last week, a Federal court struck down portions of the Association Health Plan (AHP) rule finalized by the Department of Labor (DOL) that expanded access to health insurance through these plans. Among the overturned provisions was the critical condition allowing “working owners” (sole proprietors such as real estate professionals) to be eligible for AHPs.
This ruling is a result of the lawsuit filed by 12 Attorney Generals, including Virginia Attorney General Mark Herring, against the DOL earlier this year. This lawsuit challenged two provisions necessary for our members to become eligible for health insurance coverage through AHPs.
Virginia REALTORS® will continue laying the groundwork for a health plan as this lawsuit plays out. We are hopeful the DOL will prevail in the appeals process. Meanwhile, we are actively exploring the law and seeking out every possible angle that will allow us to provide our members with healthcare insurance through an Association Health Plan.
