Q: Does Virginia law require brokers to sign all listing agreements and buyer-broker agreements, or can my agents sign them?
A: Virginia law does not expressly require brokers to sign all listing agreements and buyer-broker agreements. Agents may sign brokerage agreements so long as the agents have been granted authority by the broker to sign on behalf of the firm.
However, Virginia Administrative Code section 135-20-165 requires that supervising brokers be available to all licensees under their supervision to review and approve all brokerage agreements.
Remember, the brokerage agreement is between the firm and the client. As a supervising broker, you are responsible for ensuring that your agents are using the specific forms, terms, and conditions required by the firm in a brokerage agreement.
