Q: We manage a number of single-family homes. If the respective owners each own four or fewer rental properties, do we have to allow tenants to exercise the right of redemption an unlimited number of times?
A: No, if an owner owns four or fewer rental properties, the landlord is not required to allow for unlimited use of the right of redemption. However, in order for the landlord to limit a tenant’s use of the right of redemption, the landlord must first provide the tenant with written notice of such limitation. Section 55.1-1250 of the Virginia Residential Landlord and Tenant Act (VRLTA) says that if an owner owns four or fewer rental properties, or up to a 10 percent interest in four or fear rental properties, the landlord may limit a tenant’s use of the right of redemption to once per lease period, provided that the landlord provides written notice of such limitation to the tenant.
