It’s the time of the year again when we map out what you need to know about this summer’s form changes. Below are the form changes effective July 1st, 2026.

  1. Form 600 – Residential Purchase Contract
    1. Walkthrough Verification. Seller warrants all appliances, heating and cooling equipment, plumbing, including septic system, and electric systems will be substantially in the same working condition as they were on the date of ratification, excluding ______________________________________________________________________________ Seller will allow Buyer access to the Property to conduct a pre-settlement verification no more than _____ days prior to the Settlement Date, to ensure the condition of the Property is substantially the same as it was at
      □ ratification OR
      □ Date of the Home Inspection and any agreed upon repairs have been completed.The following language will be completely removed:
      If there is damage or changes requiring repair that have occurred to the property since ratification the Buyer will have the right to: (i) require the Seller to correct the damages prior to Settlement, (ii) negotiate a suitable remedy with the Seller; or (iii) terminate the Contract.
    2. At Settlement, Seller will deliver the deed as agreed to in this Contract, an affidavit to Buyer and Buyer’s insurance companies as to parties in possession, lack of mechanic’s liens, and that any materials or labor which may cause a mechanics lien to the Property have been paid, any applicable non-foreign status and state residency certificates, and applicable IRS 1099 certificates.
  1. Form 900 – Property Management Agreement
    1. Paragraph 40 – Clarified that any additional duties that take place when the management agreement ends and there is an end of the tenancy will need to be agreed upon separately.
    2. Paragraph 2 – Removed double negative for nonresident owner.
  2. Form 200 – Residential Lease
    1. Removed unnecessary language in the preamble.
    2. Paragraph 1 and 4 – clarified when the late fee is applied which is separate and apart from when rent is late.
    3. Paragraph 18f – removed any references to 60 days prior to orders to bring the lease current with the law.
  3. SUM-1 – Summary of Rights and Responsibilities
    1. Included a notice of what the mandatory disclosures are. This does not serve as notice of the mandatory disclosure.
    2. Included buyer beware language for land use / rollback taxes and military ground installation.
  4. Miscellaneous editorial changes to various forms harmonizing the usage of terms.
