“Do tenants have to pay rent during an eviction appeal process?”

Q: My tenant appealed the General District Court’s eviction order and paid the appeal bond. The Circuit Court has set a hearing date for two months from now. Is the tenant required to pay rent during that time?
A: Yes. The Notice of Appeal (Form DC-475) that the tenant filled out to appeal the case specifically requires them to “pay the rental amount in the rental agreement to the [landlord/PM] on or before the 5th day of each month.” If the tenant does not pay, the circuit court judge can enter judgment and an order of possession without a hearing.
