“Are buyer-specific CIC resale certificates still required?”

Q: “I heard somewhere that CIC resale certificates no longer have to be ordered in a specific buyer’s name but can instead be generic. Is that true?”
A: Technically there was never a requirement in the law that the certificate had to be ordered in a purchaser’s name. The law changed on July 1 this year to clarify that the association cannot require that the purchaser’s name be included on the completed resale certificate. The association also cannot require that the seller or seller’s agent provide the purchaser’s name prior to preparing the certificate.
