Q: I have a residential property under contract where the parties agreed by amendment to extend the Home Inspection Deadline in the VAR Home Inspection Contingency Addendum (VAR Form 600D). By extending the deadline, did we also extend the Negotiation Period and Purchaser’s Election Period?  

A: The short answer is, yes.  

The Home Inspection Deadline is a defined term in the addendum, which is the deadline by which the purchaser must complete the home inspection and decide whether to negotiate repairs or terminate the contract. The Negotiation Period is an additional time period that begins if, prior to the Home Inspection Deadline, the purchaser decides to negotiate repairs by delivering a Home Inspection Removal Contingency Addendum to the seller. The Purchaser’s Elections Period then begins after the expiration of the Negotiation Period in the event the parties cannot agree on a removal addendum.
