Q: “Does an out-of-state commercial agent need a Virginia real estate license to participate in a Virginia commercial transaction?”

A: No. Code section 54.1-2103 contains a list of situations in which a person does not have to have a valid Virginia real estate license to participate in a real estate transaction here. Specifically, paragraph (A)(10) states that any person who is licensed (in good standing) in another state can assist in a commercial transaction here in Virginia, and can be compensated by a Virginia agent for doing so. Importantly, however, the statute notes that this does not apply to any other situation (including acting in a residential transaction).
