“I have an agency agreement with a client and it is not working out. What should we do?”

Q: I have an agency agreement with a client, and it is not working out. We both don’t want to work with each other anymore. What should we do?
A: If the client does not wish to work with you and you both want to end the relationship, you and your broker should consider a termination and release. You should remember that as long as you have an active agency agreement, there are duties you have agreed to and are expected to continue carrying out. Of course, the same can be said of the client.
Is there a form for that? Yes, Virginia REALTORS® does have a form. Form 490 – Release of Brokerage Agreement. It serves as both termination and release between the firm and the client so you can both walk away from your agreement.
