On August 26, 2021, the United States Supreme Court struck down the most recent CDC Eviction Moratorium as unlawful. While Virginia still has statewide protections in place, now it is clear which set of rules tenants, landlords, and property managers must follow when tenants cannot pay rent in full each month.

During the 2021 Special Session, the General Assembly passed language that continues to restrict evictions through June 30, 2022.

In Virginia, landlords cannot terminate a lease or take action to obtain possession for nonpayment of rent from an eligible tenant except in certain circumstances.
